Background
An employee filed a claim with the First Instance Authority for Settlement of Labour Disputes (FIASLD) in Al-Khobar against a company requesting to be reinstated as their dismissal was unfair.
The FIASLD issued a ruling deeming the dismissal as fair and dismissed the case.
Decision
The employee appealed the ruling before SLHASLD claiming that the company had stopped him from working because of an issue he had not been involved in as he was physically assaulted by his colleagues.
The SLHASLD examined the case and stated the company had failed to provide evidence that it had issued a warning to the employee nor had it conducted an investigation into prove the accusations before he was dismissed. The SLHASLD added that the employee had denied attacking his colleagues and the company had failed to provide a valid reason for dismissing the employee.
The SLHASLD issued a ruling repealing the appealed ruling and requested the company to pay the employee 30000 Riyals in compensation for unfair dismissal.
