SCSLD 432/1/1389/2011

This case involved the request by an employee of the return of a guarantee letter under which he admitted he owed his employer money for a loan. Although the letter was to be returned the employee still owed the company the money for the loan and they owed him outstanding salary.

Background

An employee filed a case against a company before First Instance Authority or Settlement of Labour Disputes requesting the company provide a guarantee letter he had previously provided to the company, pay his salary, deliver his passport and permit him to get sponsorship from a different employer.

The FIASLD ruled the company should pay the employee a monthly salary of 1200 Riyals until the termination of the case and provide him with the guarantee letter. The FIASLD also ruled that the company should handover the passport and sponsorship.

The company appealed the ruling before the SLHASLD.

Decision

The SLHASLD stated the company provided the guarantee letter in which the employee had admitted that he owed 3000 Riyals to the company.
