Termination of Employment – Unfair Dismissal – Absence - Evidence
This case involved a request by an employee for reinstatement. The company had failed to allow the employee to defend himself of the charge of absence and had admitted his line manager had given approval.
Background
An employee filed a case against a company before First Instance Authority for Settlement of Labour Disputes (FIASLD) requesting the company reinstate him and pay his salary.
The FIASLD ruled that the employee should return to his post and that the company should pay his salary for the dismissal period.
Decision
The company appealed the ruling before the SLHASLD.
The SLHASLD said that the case file revealed that the company did not investigate the absence of the employee and had deprived him from defending himself. The SLHASLD said that the company admitted that the employee's absence was approved by his direct manger.
The SLHASLD upheld the appealed ruling.
