SCSLD 431/2/982/2010

This case involved a claim by an employee for various dues including holiday pay, unpaid salary and end of service gratuity. The employer tried to claim end of service gratuity was not due because this employee had encouraged their colleagues to strike but they were unable to provide sufficient evidence that the end of service gratuity was not payable. The court also confirmed that holiday pay for untaken leave was one of the employee's rights and was not affected by the reason they left the company.

Background

An employee filed a claim against a company before the First Instance Authority for Settlement of Labour Disputes requesting the company to pay his dues.

The Authority issued a ruling requesting the company to pay the employee 1367 Riyals as an end of service gratuity plus 1908 Riyals for holiday pay and a 1000 Riyals for outstanding salary. The Authority also requested the company to give the employee an exit visa with travel tickets to his country.
