SCSLD 431/2/981/2010

This case involved a request by an employee for reinstatement and compensation. The employee also requested to be given similar rights to other disabled staff members. The employee had signed a document confirming he had received all his dues including the end of service gratuity. This indicated he was not serious about being reinstated so the case was dismissed.

Background

An employee filed a case against a company before the First Instance Authority for Settlement of Labour Disputes in Jeddah requesting that the company revokes its decision to dismiss him and give him rights similar to his colleagues who have disabilities which do not affect their work as per the regulations implemented in the company. He also requested compensation for damages.

The Authority issued a ruling dismissing the requests.

Decision

The company filed an appeal before the High Authority for Settlement of Labour Disputes (SLHASLD).

The SLHASLD stated it had examined the documents and established that the employee had signed a document proving he had received all of his rights for his service including the end of service gratuity, which indicated he did not really wish to return to work.
