This case involved a claim by an employee for compensation as a result of his dismissal. The company argued this had been for disciplinary reasons but as they failed to provide evidence of the issues and that the necessary disciplinary steps required by law had been carried out the employee received the compensation.

Background

An employee filed an appeal before the First Instance Authority for the Settlement of Labour Disputes in Mecca against a company requesting they pay him compensation for the losses he had suffered as a result of the termination of his employment and that he be granted a service certificate.

The Authority issued a ruling requesting the company to pay the employee 5000 Riyals in compensation in damages and give him service certificate under Article 64 of the Labour Law.

The company appealed the ruling before SLHASLD which stated the company had claimed that the employee had not carried out his duties properly but had failed to provide evidence to prove this. The SLHASLD also stated the company had failed to prove that it had taken the necessary disciplinary steps under Article 66 of the Labour Law.
