Social Insurance – Salary – Employee’s Rights – Benefits - Evidence
This case involved a request by an employee for the General Institution for Social Insurance to pay him a salary difference, increase and allowances. A ruling was issued requiring the employee's salary to be calculated in a particular way. However the employee appealed as he had not been given a 15% salary increase. This was rejected as there was no evidence this increase was due.
Background
An employee filed a case against the General Institution for the Social Insurance and requested the elementary authority for the settlement of labour disputes order the institution to pay him a salary difference in accordance with Article 38 of the Insurance System and pay a salary increase and other allowances.
The elementary authority ruled that the institution should calculate the salary of the employee in accordance with Article 38 of the Insurance System.
Decision
The employee appealed the ruling before the High Authority for the Settlement of Labour Disputes and stated the elementary authority had not ordered the institution to pay him a salary increase of 15%.
