SCSLD 431/2/437/2010

This case involved a request by an employee for reinstatement and unpaid salary. The employee had followed an order to transfer to a new branch but the company had ordered another transfer without a valid reason so he should be reinstated.

Background

An employee filed a case against a company and requested the elementary authority for the settlement of labour disputes to order the company to reinstate him and pay his salaries and consider his service as being continuous.

The elementary authority ruled that the employee should be reinstated and the company should pay the employee all his salary.

The company appealed the ruling before the High Authority for the Settlement of Labour Disputes.

Decision

The high authority stated the employee had obeyed the orders of the company and moved to the company's branch in Mecca. The high authority stated the company had failed to provide legitimate reasons for transferring the employee to Riyadh.

The high authority upheld the elementary ruling.
