This case involved a claim by an employee for unpaid salary. The key issue in this case was the employee had been dismissed for an absence. However, as the employee had already received a warning for this same absence they had effectively received two penalties for the same violation which violated the labour law.
Background
An employee filed a claim before the First Instance Authority for Settlement of Labour Disputes against a company requesting they pay unpaid salary.
The Authority issued a ruling requesting the company to pay the employee 55430 Riyals under Article 109 of the Labour Law and dismissed the rest of his requests.
The company and the employee filed appeals before the High Authority for Settlement of (SLHASLD).
