This case involved a request by an employee for their dues. On appeal an additional request for pay in lieu of notice was made. This was rejected as the request had not been put before the lower authority.

Background

An employee filed a case against a company and requested the elementary authority for the settlement of labour disputes to order the company to pay him holiday pay, severance pay and the unpaid salary.

The elementary authority ruled that the company should pay the employee 1011.50 Riyals for holiday pay, and 963.33 Riyals for severance pay but rejected the other requests.

The employee appealed the ruling before the High Authority for the Settlement of Labour Disputes and requested the high authority to order the company to pay him pay in lieu of notice in addition to the unpaid salary.

Decision

The high authority stated the requests made by the employee had not been introduced to the elementary authority previously so could not be considered for the first time before the high authority according to Article 66 of the Pleadings Law.

The court upheld the elementary ruling.
