This case involved a claim by an employee for various benefits including unpaid salary, holiday pay, overtime pay and end of service gratuity. The employee was a sales representative so his request for overtime was rejected as common practice for staff of this type was to receive commission not overtime. Issues which had only been raised for the first time at appeal were also rejected.

Background

An employee filed a case against a company with the First Instance Authority for Settlement of Labour Disputes (FIASLD) in A'sir requesting the company to settle his labour rights.

The First Instance Authority issued a ruling requesting the company to pay the employee 6520 Riyals for outstanding salary, 21600 Riyals as an end of service gratuity, 3500 Riyals for the holiday pay due for one year only, 16619 Riyals for overtime, and to pay for travel tickets for the employee and his family to return to his country.
