SCSLD 431/2/1508/2010

This case involved a claim by an employee for unpaid dues. The employee had returned to work but the company had then reduced her wages which they did not have the right to do.

Background

An employee filed a case against a company and requested the elementary authority for the settlement of labour disputes to order the company to pay her dues.

The elementary authority ruled that the company should pay the employee 5826.94 Riyals and the employee should be deported at the company's expenses.

The employee appealed the ruling before the High Authority for the Settlement of Labour Disputes.

Decision

The high authority stated the employee had requested compensation for the period she did not work in. The high authority stated the employer had granted the employee annual holiday and when she returned to the work, the employer decided to decrease the employee's salary or to refer her to another sponsor. The high authority stated it was against the law for the employer to decrease the employee's salary.

The high authority upheld the elementary ruling and ruled that the company should pay the employee additional 10000 Riyals as compensation.
