This case involved a request by an employee for reinstatement. Relations between the employee and the company and their colleagues had deteriorated, and as the authority had rights to either order a reinstatement or payment of compensation in such cases, they ordered compensation.

Background

An employee filed a claim with the First Instance Authority for Settlement of Labour Disputes in Jeddah against a company requesting his reinstatement.

The Authority dismissed the claim and the employee appealed the decision before the High Authority for Settlement of Labour Disputes (SLHASLD).

Decision

The SLHASLD stated the working relationship between the employee and the company and their colleagues had deteriorated and the law permitted the Authority in this case to either reinstate the employee or pay him compensation in line Article 58 of the Litigation Charter. Therefore the SLHASLD disagreed with the appealed ruling.

The SLHASLD issued a ruling revoking the ruling (Decision No. 811) and requested the company to pay the employee 26286 Riyals in compensation for their dismissal.
