This case involved an award of compensation to an employee who had been unfairly dismissed. As the employee had signed a final settlement and received severance pay and pay in lieu of notice he was not due compensation.

Background

An employee filed a case against a company and requested the elementary authority for the settlement of labour disputes to order the company to pay his dues.

The elementary authority ruled the company should pay the employee 200000 Riyals in compensation for the unfair dismissal and 10000 Riyals in expenses for a lawyer. The elementary authority also ruled that the company should provide the employee with all relevant documents and pay their fight ticket.

The company appealed the ruling before the High Authority for the Settlement of Labour Disputes.

Decision

The high authority stated the case documents had revealed that the employee had signed a final settlement after he had finished his service by which he had received severance pay and pay in lieu of notice so did not deserve compensation.

The high authority abandoned the first point in elementary ruling and upheld other points.
