SCSLD 431/1/604/2010

This case involved a request for reinstatement by an employee who had been dismissed six days before the end of their probation. Employers had the right to dismiss employees at any point during their probation.

Background

An employee filed a case against a hospital and requested the elementary authority for the settlement of labour disputes to order the hospital to reinstate her. The employee stated she had been dismissed from the job six days before the end of the probation period.

The elementary authority rejected the case.

The employee appealed the ruling before the High Authority for the Settlement of Labour Disputes.

Decision

The representative of the hospital stated the dismissal decision complied with Article 80/6 of the Labour System which issued by Saudi Arabia Royal Decree No. 51, which stipulated that an employee can be dismissed from their job during the probation period.

The high authority stated this argument was valid and upheld the elementary ruling.
