SCSLD 431/1/2257/2010

This case involved a request by an employee for the payment of a monthly bonus normally given to industrial security officers. This had been detailed in a Ministerial Decision and it was the employer's duty to implement this Decision.

Background

An employee filed a case before the First Instance Authority for Settlement of Labour Disputes in Ha'il requesting a company to pay him a monthly bonus usually paid to the industrial security officers which was equal to 15% of the basic salary.

The Authority issued a ruling requesting the company to pay the employee the amount.

The company filed an appeal against the ruling before the High Authority for Settlement of Labour Disputes (SLHASLD).

Decision

The SLHASLD stated it had examined the case and established that the employee worked for the appealing company. The SHASLD requested confirmation from the High Authority for Industrial Security as to whether the company should implement the regulatory directives for industrial security issued by the Industrial Security Authority. The Industrial Security Authority confirmed that the company was responsible for applying the directives issued in the Saudi Arabia Ministerial Decision Mo. 2139/1983.

Therefore, the SLHASLD issued a ruling upholding the appealed ruling.
