Litigation Procedure – Immigration – Work Permit – Employees registered with another company – Deportation
This case involved employees who had been illegally employed by one employer while registered with another employer. Both the employer and employees were fined - and the employees were to be deported. The case was returned to the First Instance Authority as the employer had not been present at the hearing there and had not been able to defend themselves.
Background
The Labour Department filed a case against company and employees before the First Instance Authority for Settlement of Labour Disputes in Riyadh claiming they had violated Article 39 of the Labour Law on the employment of employees who were registered with others.
The Authority issued a ruling (No. 1556) recognising the company's and employee's violation Article 39 of the Labour Law and requested the company to pay 10,000 Riyals and the employees to pay 5000 Riyals. The Authority also ordered the employees to be deported at the company's expense of the company.
The company filed an appeal before the High Authority for Settlement of Labour Disputes (SLHASLD) in Riyadh.
