Work Permits – Employer’s Duties – Saudisation Targets
This case involved an employer who had not reached Saudisation targets and had employed employees in jobs which differed from those in their work permits. Fines were levied.
Background
The Labour Ministry brought a claim against an employer and an employee claiming that the employer had failed to achieve the Saudisation target stipulated in Article 45 of the Labour Law. The Ministry requested that the punishment outlined in Article 195 of the Labour Law is imposed on the employer.
The Ministry also stated the employer employed some of his employees in posts which were different to those stated on their work permits without obtaining approval from the Labour Office and as such the employer and the employees had violated the provisions of Article 49 of the Labour Law. The Ministry requested that the punishment outlined in Article 196 of the Labour law be imposed on the employer and the employees.
