This case involved a new car which had been purchased but was found to have a manufacturing fault. The company offered to repair it. The key point was following the expert report the judge rule the money should be refunded and the car returned to the seller as the contract was invalid.

Background

A customer filed a case before Riyadh General Court claiming he had bought a car from a company worth 90,000 Riyals but had discovered there were faults in the car and it needed repair from time to time. He claimed the fault was a manufacturing fault and he had read about this model having has a manufacturing fault in the papers. The customer requested the company to refund the cost of the car or to replace it with another car. He had left the car with the company for a year and refused to take it back.

The company's legal representative stated the company was ready to repair faults regardless of their causes.
