SCC 112/19/1

This case involved a wife who had requested that her marriage contract be dismissed as her husband was absent. It was confirmed he had been deported following a criminal conviction. The court dismissed the marriage contract.

Background

A woman filed a case against her absent husband at Riyadh Major Court claiming that she had married him when he had stayed in Saudi. The woman stated a criminal ruling had been issued against the husband, he had been jailed and then deported to his own country. She requested the court to dismiss the marriage contract.

Decision

The court asked the Emir's agent in Riyadh about the husband's case. He had been jailed for fraud, had HIV according to a medical report and had been deported from Saudi Arabia.

The court ruled that the marriage contract should be dismissed and the woman should not be able to get married until the ruling became an absolute one.

The court of cassation upheld the ruling.

The citation and date listed is that of Riyadh Major Court as the court of cassation merely upheld the ruling.
