SCC 154/9
Background
A claimant filed a case against a defendant at Medina General Court claiming he had agreed to build a building with two floors for him. The claimant stated the contractor had laid down the basis for the building; however, the claimant recognized later this had many issues and would not be able to bear the weight of the building according to a laboratory test. He requested the court to order the defendant to demolish what he had already built and pay back 40,000 Riyals he had received from the claimant and provide 7,000 Riyals to cover the cost of laboratory test.
The defendant admitted the contract with the claimant but stated he had has nothing to do with the claim that the basis for the building had many issues. The defendant also stated the laboratory test was not persuasive.
Decision
The court sent an expert to evaluate the situation. The expert confirmed the results of the previous tests.
