Background

This case concerns a commercial dispute between a trading company and a food supply company. The claimant, a trading establishment, alleged that it had supplied food products to the defendant based on specific orders for distribution in the southern region, but the defendant had failed to pay for these supplies. The amount initially claimed was 982,364.52 Saudi riyals. The claimant filed an earlier lawsuit with the commercial court, during which a chartered accountant was appointed to examine the financial transactions. The accountant’s report concluded that, after accounting for bank payments and other adjustments, the claimant was entitled to only 132,372.98 riyals. The commercial court issued a judgment confirming this entitlement and stated the claimant could pursue amounts identified in the expert’s report in a separate action if requested. The present case arose from the claimant’s subsequent action seeking enforcement of the sum determined by the expert report.
