SCA 994/2019
This case involved a claim for compensation and expert costs. There was a previous ruling on the compensation and as the expert had been appointed by the claimant the defendant was not required to pay their costs.
Background
A claimant filed a case against a defendant before the court. He requested the court to order the defendant to pay him expenses he had paid to an expert he had appointed in a previous case plus compensation for damage. He said that the defendant had failed to commit to his obligations in this regard.
Decision
The court said that the case documents revealed that the claimant had appointed the expert and therefore the defendant should not pay his expenses. The court said that the court had already ordered the defendant to pay compensation to the claimant.
The court dismissed the case and said that it had been already considered.
The Court of Appeal – Jeddah upheld the ruling based on same grounds.
