SCA 977/2019
The initial dispute involved non-payment of rental for cars. The defendant did not attend the session so the claimant was asked to submit a case statement. As they repeatedly failed to do so the court had the right to dismiss the case.
Background
The representative of a claimant requested from the Commercial Court in Jeddah that the defendant pay for the rent of the cars the claimant had rented to the defendant. A number of sessions were held but the defendant did not attend and did not send a representative. A note was sent by the police confirming stopping the services for the defendant and the court offered the claimant to consider the case in the absence of the defendant. The claimant accepted and asked for some time to draft the case statement. However, in a following session the court found out that the claimant had not submitted the statement so the case was prepared for issuing the judgment.
