This case involved the sale of a factory and whether some cars had been included in the purchase. A key point was the car were not mentioned in the sales contract.

Background

A claimant filed a case against a company before the court. He said that he had bought a factory from the company and that he committed to his obligations in this regard. He said that the company had failed to transfer the ownership of some assets in the factory to him including several cars. He requested the court to order the company to transfer the ownership of these assets.

The company claimed that the cars were not part of the deal to sell the factory and they were owned by the company.

Decision

The court said that the case documents revealed that the contract had been signed between the two parties and had not mentioned the cars. The court said that the claimant had failed to prove his claims that the cars were part of the deal between the two parties.

The court dismissed the case.

The Court of Appeal – Jeddah upheld the ruling based on same grounds.
