SCA 933/2019
This case involved the failure to pay the full amount due for purchased raw materials. There was a claim by the defendant that they were an irrelevant party and the transaction did not exist. This was dismissed without evidence of this defence.
Background
A claimant filed a case against a company before the court. He said that he had supplied the company with raw materials and that the latter had failed to pay their remaining value. He requested the court to order the company to pay 183000 Riyals.
The company said that they were an irrelevant party in the case and that the transaction had not existed.
Decision
The court said that the case documents revealed that the claimant had provided the court with the documents that prove his claims. The court said that the company had failed to prove that they were an irrelevant party in the case.
The court ruled that the company should pay the claimant 183000 Riyals.
The Court of Appeal – Riyadh upheld the ruling based on same grounds.
