SCA 915/2019

This case involved an unpaid amount for a contract to install elevators. A key issue was who was responsible for the work not being fully completed which had been caused by there being no electricity supply in the building.

Background

A company filed a case against a company before the court. The company requested the court to order the other company to pay 113500 Riyals. The company said that they had supplied and installed elevators for the other company but the latter had failed to pay the remaining value of the contract.

The other company said that that the last payment should be made after the final delivery and that the company had not yet fully delivered the project .

Decision

The court said that the case documents revealed that the signed contract stipulated that the company should not be responsible for the delay in supplying electricity to the building. The court said that the other company had claimed that they did not receive the elevators due to the delay in getting the electric supply. The court said that the other company had violated the contract.

The court ruled that the other company should pay the company 113500 Riyals.
