SCA 888/2019

This case involved whether a contract should be dismissed when a building project was not completed by the agreed deadline.

Background

A legal representative of a claimant filed a case against a defendant before the court. He said that the defendant had agreed to build 20 villas for the claimant within 24 months for 16454521 Riyals. He said that the claimant paid the defendant 11500000 Riyals. He said that the defendant failed to complete the project. He requested the court to dismiss the contract between the two parties. He also requested the court to order the defendant to pay the penalty.

Decision

The court appointed an accountant and an engineer in order to consider the dispute between the two parties. The court said that the experts concluded that the defendant had finished almost the whole project before the deadline agreed for the completion.

The court dismissed the case.

The legal representative of the claimant appealed the ruling before the court of appeal.

The court dismissed the appeal and upheld the appealed ruling.
