SCA 878/2019

This case involved underpayment on a contract. There was a lack of evidence but an oath was taken.

Background

A claimant filed a case against a company before the court. He requested the court to order the company to pay him 730848 Riyals. He said that he had supplied the company with sand but the company had failed to pay the value of the contract.

The company admitted the existence of the transaction but they requested the court to order the claimant to provide the relevant documents.

Decision

The court said that the case documents had revealed that the claimant had already provided the court with the relevant bills. The court said that the claimant took the oath in order to prove his claims.

The court ruled that the company should pay the claimant the mentioned amount.

The Court of Appeal – Riyadh upheld the ruling based on the same grounds.
