SCA 871/2019
This case involved underpayment for contracted work. The claimant had failed to provide evidence of the claim but the defendant refused to take the oath.
Background
A claimant filed a case against a defendant before the court. He requested the court to order the defendant to pay him 102000 Riyals. He said that he had finished contracting work for the defendant and the latter failed to pay the full value of the contract.
The defendant said that the claimant had failed to execute the signed contract. He also said that he had paid 800000 Riyals to the claimant and not 798000 Riyals as he claimed.
Decision
The court said that the case documents had revealed that the claimant had failed to execute the contract. The court also said that the documents revealed that the claimant had failed to provide the evidence that prove his claims as well. The court said that the claimant therefore had the option to ask the defendant to take the oath in order to deny his claims. The defendant, however, refused to take the oath.
The court ruled that the defendant should pay the claimant 100000 Riyals.
