This case involved outstanding money for construction work. A key issue was the ruling had been in absentia and there had been issues with notification.
Background
The representative of the claimant filed a claim with the Commercial Court of Riyadh requesting the defendant to pay 19607 Riyals for some building work in line with a contract signed and the confirmation of the balance. A ruling in absentia was issued in this case and it was referred to the Appeal Court in Riyadh (Appeal No. 482-2019).
Decision
The Court said that the case had started in 2017 with a request to pay 19607 Riyals and that the court had served a notice to the defendant at the address recorded on its commercial record. However, the Interior Court had informed the court that it had not been possible to serve a notice to the defendant and despite the suspension of offering the defendant services the latter did not visit the court. The appeal court reviewed the ruling pursuant to Saudi Arabia Cabinet Decision No. 11/1435 and concluded that it should be upheld based on the same grounds.
Therefore the court upheld the ruling which requested the claimant to pay 19607 riyals.
