SCA 82/2019

This case involved a claim for payment for the sale of frozen chickens. It was claimed these chickens were rotten and had caused losses. The Food and Drugs Authority confirmed the condition of the chickens on sale.

Background

A company filed a case against a company before the court. The company requested the court to order the other company to pay 1092734 Riyals in addition to compensation. They said that they sold frozen chickens to the other company but the latter failed to pay their value.

The other company said that frozen chickens were rotten and had caused them large losses. They requested the court to dismiss the case.

Decision

The court said that the case documents revealed that the the Food and Drugs Authority had confirmed that the chickens were in good condition when the other company bought them. The court said that the other company had failed to prove the responsibility of the company for the losses they mentioned.

The court ruled that the other company should pay the amount.

The court of appeal has upheld the ruling based on the same grounds.
