SCA 80/2019
This case involved a claim for compensation and to pay debts after an individual purchased a share in a factory and claimed the defendant had managed it badly. The key issue was a document proved as evidence after a plea for reconsideration was considered irrelevant.
Background
A claimant filed a case against a defendant before the court. He said that he had signed a contract with the defendant in order to acquire a share in a limited company. He said that a factory owned by the company in which he acquired the share was valued at 5160000 Riyals. He said that the defendant failed to run the factory and caused losses for him. The claimant requested the court to order the defendant to pay 1790000 Riyals in addition to 4000000 Riyals as compensation and to pay the factory's debts as well. He also requested the court to dismiss the signed contract.
Decision
The court dismissed the case.
The claimant appealed the ruling before the court of appeal. The court upheld the appealed ruling.
The claimant made a plea to the court of appeal. The claimant provided the court with a new document in order to prove his claim.
