This case involved non-delivery of goods where it was claimed a guard at the customer's premises had prevented delivery. Costs were awarded.
Background
A company filed a case against a company before the court. It requested the court to order the other company to pay 518500 Riyals. It said that it had paid theamount to the other company in order to supply raw materials but the latter had failed to commit to its obligations.
The other company admitted the claim made by the company but argued that the company's guard had prevent their employees from executing the agreed project. The other company failed, however, to prove this claim.
Decision
The court ruled that the other company should pay the mentioned amount in addition to lawyer's expenses of 50000 Riyals.
The other company appealed the ruling before the court of appeal.
The court dismissed the appeal and upheld the appealed ruling.
