SCA 782/2019
This case involved non-payment of the full amount owed by a company for purchased raw materials. There was a dispute on the accuracy of the amount claimed. The key point was that stamps on documents used as evidence meant these documents were an expression of the owner's will.
Background
A legal representative of a claimant filed a case against a company before the court. He requested the court to order the company to pay 354589 Riyals. He said that he had supplied the company with raw materials and it failed to pay the full amount.
The legal representative of the company said that the amount request by the claimant was inaccurate. He had proposed a reconciliation agreement between the two parties or the appointment of an accountant in order to consider the case. He admitted that the stamps on the documents provided by the claimant belonged to the company.
Decision
Article 139 of Saudi Arabia Cabinet Decision No. 11/1435 stipulated that the stamps were considered as an expression of the will of their owner.
The court ruled that the company should pay the mentioned amount to the claimant.
