This case involved a dispute over a contract to provide financial consultancy services to a merchant. As a result the case did not fall under this court's jurisdiction.

Background

A company filed a case against a company before the court. The company requested the court to dismiss a signed contract and pay the  money they had received. The company said that the second company had agreed to provide financial consultancy but they failed to commit to their obligations.

The second company requested the court to dismiss the case because its consideration did not fall under the court's jurisdiction.

Decision

The court said that the case documents revealed that the dispute was between a merchant and a company that wanted to provide him with financial consultancy. The court said that the consideration of the case therefore did not fall under the jurisdiction of the court according to Article 35 of the commercial court law.

The court of appeal upheld the ruling based on the same grounds.
