SCA 746/2019

This case involved the sale of furniture to a wedding hall. As the defendant was not a merchant the commercial court did not have jurisidiction.

Background

A claimant filed a case against a defendant before the court. He requested the court to order the defendant to pay him 1231500 Riyals. He said that he had supplied and installed furniture in a wedding hall which was owned by the defendant.

Decision

The court said that the case documents revealed that the defendant was not a merchant.

The court ruled that the consideration of the case did not fall under the jurisdiction of the commercial court.

The Court of Appeal – Riyadh upheld the ruling based on same grounds.
