SCA 723/2019

This case involved investors in a company who had signed an investment contract but later discovered an agreed point had not been included. The case was dismissed because they had signed the contract which proved they had been happy with it.

Background

Some Claimants filed a case against defendants before the court. They requested the court to dismiss the contract which had been signed between the two parties and to order the defendants to pay some amounts of money. They said that they had bought the defendants' share in a company and they requested some amendments to the contract but they discovered later that the defendants had failed to make the amendments.

The defendants said that the claims made by the claimants were invalid. They said that the contract which was signed involved the claimants' investment in the company and had nothing to do with buying shares.

Decision

The court said that the case documents revealed that the claimants had signed the contract and had not objected to it which meat that they were satisfied with it.

The court dismissed the case.

The Court of Appeal – Jeddah upheld the ruling based on the same grounds.
