SCA 710/2019
This case involved a request to dismiss a car sales contract as it was stated the seller did not own the cars he was selling. This was irrelevant as the contract had not been breached. However, a reconciliation agreement was reached which the court validated.
Background
A company filed a case against a defendant before the court. The company requested the court to dismiss the contract which had been signed with the defendant to sell them 90 cars. The company said that they had discovered that the defendant did not own the cars.
The defendant said that he was committed to the signed contract and that the case filed by the company was invalid.
Decision
The court said that the case documents revealed that the defendant had not failed to execute the contract.
The court dismissed the case.
The Court of Appeal – Jeddah said that the two parties had reached a reconciliation agreement. The court repealed the ruling and validated the agreement.
