SCA 708/2019
This case involved payment of goods in a contract signed by a project manager, where the company denied the project manager had agency to sign the contract. The claimant failed to attend the hearing so the appeal was dismissed.
Background
A claimant filed a case against a company before the court. He requested the court to order the company to pay him 217992 Riyals. He said that he had supplied the company with raw materials and that the latter failed to pay their values. The claimant provided the court with the bills signed by the company project manager.
The company denied the claims made by the claimant and said that it had nothing to do with the project manager. The company requested the court to order the claimant to take the oath in order to prove his claims. The claimant refused to take the oath.
Decision
The court dismissed the case.
The claimant appealed the ruling before the court of appeal.
The claimant failed to attend the appeal hearing and therefore his right in appeal was dismissed in accordance with Article 190(1) of the Law of Advocacy.
The court upheld the appealed ruling.
