SCA 54/2019

This case involved the use of an oath to prove whether an investor in a company had been paid their capital and profit share.

Background

A claimant filed a case against a defendant before the court. He requested the court to order the defendant to pay him 327500 Riyals in addition to his share in the profits. He said that he had paid the defendant an amount of money in order to invest it but the latter failed to commit to his obligations.

The defendant said that he had already paid the claimant the capital and his share in the profits. The claimant took the oath in order to deny the defendant's claim.

Decision

The court ruled that the defendant should pay the claimant the mentioned amount.

The defendant appealed the ruling before the court of appeal.

The court dismissed the appeal and upheld the appealed ruling.
