SCA 531/2019

This case involved amounts owed under a contract to fix a communication network which it was said was already terminated. Issues included the status of a witness statement by an employee of one of the parties and a settlement agreement.

Background

A claimant filed a case against a defendant before the court. He requested the court to order the defendant to pay him an amount of money. He said that he had fixed a communication network for the defendant and that the latter failed to pay him the full value of the contract.

The defendant said that the contract provided by the claimant had already terminated. He said that the two parties had reached a final settlement after the termination of the contract.

Decision

The court said that the testimony of the witness was invalid because the witness worked for the defendant.

The court dismissed the case.

The claimant appealed the ruling before the court of appeal. He requested the court to order him to take the oath to deny the claims made by the claimant.

The claimant then provided the court with a reconciliation agreement signed by the two parties.
