SCA 43/2019
This case involved amounts unpaid to a sub-contractor for raw materials. As the defendant refused to take the oath the court ruled in the claimant's favour.
Background
A legal representative of the claimant filed a case against a defendant before the court. He said that the claimant was a sub-contractor of the defendant and that they had provided the defendant with the raw materials needed for a project. He said that the defendant had failed to pay the remaining value of the materials. He requested the court to order the defendant to pay 1863333.25 Riyals.
Decision
The court requested the defendant take the oath but the defendant failed to do so.
The court ruled that the defendant should pay the claimant the mentioned amount.
The legal representative appealed the ruling before the court of appeal. The court upheld the appealed ruling.
