SCA 404/2019
This case involved the obligations of a storage company which had been storing goods and there had been a fire in their warehouse.
Background
A claimant filed a case against a company before the court. He said that he had stored his goods in the company's warehouse but the company had refused to return his goods. He requested the court either to order the company to return the goods or pay their value.
The company said that a fire had broken out in the warehouse and the investigation was still ongoing. The company requested the court to dismiss the case.
Decision
The court said that case documents revealed that the company had failed to provide the court with evidence that they had taken care of the goods. The court said that companies whose work involved storing goods should insure their warehouses. The court said that the company should be compensated for the damage which had resulted from the fire.
The court ruled that the company should pay the claimant 558788 Riyals.
The Court of Appeal – Jeddah upheld the ruling based on the same grounds.
