This case involved what should happen if there was a failure to appoint a third arbitrator.
Background
A legal representative of a claimant filed a case against a defendant before the court. He said that he had previously made a request asking the court to appoint an arbitrator for the defendant. He said that the defendant appointed an arbitrator at the time and therefore the court dismissed the case. He said that the two parties, however, had failed to appoint a third arbitrator. He requested the court to appoint this arbitrator.
Decision
The court said that Article 15 of Saudi Arabia Royal Decree No. M34/1433 stipulated that if the disputed parties failed to appoint a third arbitrator, the court should take the responsibility in this regard.
The court ruled that a third arbitrator should be appointed. The court also determined his expenses.
