SCA 339/2019
This case involved the failure to pay for travel tickets. Although a settlement had been reached between the two parties, this had been breached by a failure to pay the first agreed instalment.
Background
A company filed a case against a company before the court. The company requested the court to order the other company to pay 645191 Riyals. The company said that the other company had bought travel tickets from them and failed to pay.
Decision
The other company said that the transaction had existed. The other company said that they had reached a settlement agreement with the company in order to pay the mentioned amount in instalments but the company had violated the agreement.
The court said that the case documents revealed that the other company was the party that violated the agreement because they had failed to pay the first instalment.
The court ruled that the other company should pay the company theamount.
The Court of Appeal – Riyadh upheld the ruling based on the same grounds.
