SCA 330/2019

This case involved the amount owed for a construction project which had not been completed and the agreed amount had not been paid. An expert was appointed to assess the amount owed.

Background

A claimant filed a case against a defendant before the court. He said that he had agreed with the defendant on a contracting project for 425000 Riyals. He said that the defendant owed him 191000 Riyals. He requested the court to order the defendant to pay this amount.

The defendant said that he had signed a contract with the claimant but he refused to pay the remaining value of the contract because the project had not bee completed.

The court appointed an expert in order to consider the dispute. The expert concluded that the defendant owed the claimant 53000 Riyals.

Decision

The court ruled that the defendant should pay the claimant 53000 Riyals.

The defendant appealed the ruling before the court of appeal.

The court dismissed the appeal and upheld the appealed ruling.
