SCA 301/2019

This case involved what should be paid in a construction dispute where work had been stopped as the full amount had not been paid. An oath was taken by the claimant to prove he had not not paid the full amount. An expert was appointed to decide the value of the completed work.

Background

A claimant filed a case against a company before the court. He said that the company had agreed to build a building for him for 275000 Riyals. He said that he paid the company 245000 Riyals. He said that the company failed to complete the project. The claimant requested the court to order the company to either pay back the amount he had paid or complete the project.

The legal representative of the company claimed that the claimant had only paid 215000 Riyals and that he had ordered the company to suspend the project. The claimant took the oath to deny these claims.

Decision

The court appointed an expert in order to consider the dispute. The expert concluded that the value of what the company had completed was 67100 Riyals.

The court ruled that the company should pay the claimant 179900 Riyals.
