SCA 292/2019
This case involved non-payment for contracting work. The defendant claimed they had agreed he would not pay until he had agreed a sizing. This contradicted an admission that part of the amount had been paid.
Background
A claimant filed a case against a defendant before the court. He requested the court to order the defendant to pay him 354625 Riyals. He said that he had finished contracting work for the defendant and that he had failed to commit to his obligations.
The defendant has admitted the existence of transaction but he said that the two parties had agreed that he would not pay the value of contract before receiving the sizing for the work from the claimant.
Decision
The court said that the case documents revealed that the claims made by the defendant included contradictions because he had admitted previously that he had paid the claimant part of the contract value. The court said that the claimant provided the court with documents that proved his claims.
The court ruled that the defendant should pay the claimant the mentioned amount.
The Court of Appeal – Medina upheld the ruling based on the same grounds.
