SCA 291/2019
This case involved a claim by some heirs about the breach of a contract to build a building. An expert was appointed to assess the value of work done. A key issue was if the heirs had filed against the right party.
Background
The heirs of a deceased man filed a case against a defendant before the court. They said that the defendant agreed with their father that he would build a building valued at 7000000 Riyals and that he received 5000000 Riyals. They said that the defendant had failed to commit to his obligations. They requested the court to appoint an expert in order to assess the work the defendant finished. They also requested the court to order the defendant to pay 150000 Riyals as compensation.
The defendant said that he only received 460000 Riyals. He took the oath in order to prove his claims.
Decision
The court appointed an expert in order to consider the dispute. The expert concluded that the finished work valued at 330000 Riyals.
The court ruled that the defendant should pay the heirs 130000 Riyals.
